These Terms of Use ("Terms") govern your access to and use of the Clarity Path LLC website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Nature of the Service

Clarity Path LLC provides the ClarityPath software platform, which helps users document coparenting interactions, store communications and files, organize incidents, analyze behavioral patterns, and generate summaries or draft reports. ClarityPath is designed to assist users in organizing information related to coparenting interactions and custody disputes. Clarity Path LLC is not a law firm, legal service provider, therapist, counselor, or mediator.

2. No Legal Advice

ClarityPath does not provide legal advice. Any information, analysis, summaries, or suggestions generated through ClarityPath are provided for informational and organizational purposes only. Use of the Service does not create: • an attorney-client relationship • a therapist-client relationship • any professional advisory relationship. Users should consult a licensed attorney before making legal decisions or taking legal action.

3. AI-Generated Content Disclaimer

ClarityPath uses artificial intelligence to analyze user-provided content and generate summaries, suggestions, and draft documents. AI-generated outputs: • may contain inaccuracies • may be incomplete • may misinterpret uploaded materials. Users are solely responsible for reviewing and verifying any AI-generated outputs before relying on them. Clarity Path LLC makes no guarantees regarding the accuracy, completeness, or reliability of AI-generated information.

4. Draft Document Disclaimer

ClarityPath may generate draft documents such as summaries, declarations, incident reports, or other written materials. All generated documents are drafting tools only. Users are solely responsible for reviewing, editing, and verifying any generated documents before sharing them with third parties, including attorneys, mediators, or courts. Clarity Path LLC does not guarantee that any generated document is legally sufficient or appropriate for court submission.

5. Evidence Admissibility Disclaimer

ClarityPath provides tools for organizing communications and evidence materials. Clarity Path LLC does not determine whether any material is admissible in court. Rules of evidence vary by jurisdiction and by case. Users should consult a licensed attorney regarding evidentiary requirements.

6. User-Generated Content Responsibility

Users may upload documents, communications, screenshots, images, and other materials to ClarityPath. Users retain ownership of their uploaded content. By uploading content, users represent and warrant that they have the legal right to upload and store the material, and that the material does not violate any laws or third-party rights. Users are solely responsible for the legality, authenticity, and accuracy of uploaded materials. Clarity Path LLC does not review, verify, or endorse user-generated content.

7. Acceptable Use

Users agree not to use ClarityPath to: • upload fabricated or falsified evidence • harass, threaten, or abuse others • violate court orders • impersonate another person • upload unlawful or defamatory materials. Clarity Path LLC reserves the right to suspend or terminate accounts that violate these Terms.

8. Behavioral Pattern Analysis Disclaimer

ClarityPath may identify and label behavioral patterns based on incidents you log, such as "Chronic Schedule Disregard" or similar descriptors. These pattern labels are organizational and informational tools generated from your self-reported data. They are not clinical findings, psychological assessments, forensic evaluations, or expert opinions. Pattern labels generated by ClarityPath must not be presented to a court, evaluator, or any third party as expert analysis, clinical diagnosis, or professional opinion. They represent your documented observations organized by ClarityPath, nothing more. Users experiencing emotional distress should seek assistance from qualified mental health professionals. ClarityPath may also reference communication frameworks, conflict resolution concepts, or educational materials related to emotional well-being. These materials are provided for informational purposes only and do not constitute mental health counseling, therapy, or psychological treatment.

9. Not for Emergency Situations

ClarityPath is not intended for emergency situations. If you or your child are in immediate danger or require urgent assistance, contact local emergency services or law enforcement.

10. Evidence Storage and Organization

ClarityPath allows users to store and organize communications, documents, and other materials. While ClarityPath provides tools for organizing materials, Clarity Path LLC does not verify authenticity, does not validate the accuracy of materials, and does not guarantee admissibility in legal proceedings. Users are responsible for determining how materials are used in legal or other contexts.

11. Data Security and Privacy

Clarity Path LLC implements reasonable technical and administrative safeguards designed to protect user data. However, no system can guarantee absolute security. By using ClarityPath, users acknowledge that data transmission and storage involve inherent risks. Users should exercise caution when uploading sensitive information. 12. Data Loss Disclaimer

While Clarity Path LLC uses reasonable safeguards, ClarityPath does not guarantee that user data will never be lost, corrupted, or inaccessible. Users are responsible for maintaining independent backups of important documents or evidence.

13. Export and Sharing Responsibility

ClarityPath may allow users to export documents, reports, or evidence bundles. Users are solely responsible for determining how exported materials are used, shared, or submitted to attorneys, courts, mediators, or other third parties. Clarity Path LLC is not responsible for any consequences arising from the use or disclosure of exported materials.

14. Age Requirement

ClarityPath is intended only for individuals 18 years of age or older. By using the Service, you represent that you are at least 18 years old.

15. Children's Privacy (COPPA)

Clarity Path LLC is committed to protecting the privacy of children. This section describes how we handle information about children that is voluntarily provided by parents or legal guardians. WHAT CHILD INFORMATION IS COLLECTED Clarity Path LLC may collect certain information about children solely when voluntarily provided by you, the parent or legal guardian, including: • The child's first name (used to personalize coaching, incidents, and documents) • The child's date of birth (optional; used only if provided during profile setup) Clarity Path LLC does not collect information directly from children. Children do not create accounts or directly interact with ClarityPath. WHY IT IS COLLECTED Child information is collected solely for the purpose of: • Personalizing AI coaching and communication suggestions to your specific custody situation • Generating court-ready declarations and incident records that accurately reference your children • Organizing incidents and patterns by child, where relevant HOW IT IS USED Child information is used only within your account to provide and improve the Service for you. Clarity Path LLC does not: • Share child information with third parties for advertising or marketing • Use child names or birthdates to build profiles of children • Sell, rent, or otherwise disclose child information to any third party AI-generated content that references your child uses only the information you provide. RETENTION Child information is retained for as long as your account remains active. When you delete a child record from your profile, that record is permanently removed. When you close your account, all associated child data is deleted. PARENTAL RIGHTS As the parent or legal guardian providing this information, you have the right to: • Review the child information stored in your account at any time via your Profile • Correct or update child information at any time via your Profile • Delete any or all child records from your account at any time via your Profile • Request complete deletion of all data associated with your account by contacting us To exercise any of these rights, visit your Profile or contact us at sarah@clarity-path.ai.

16. Court Order and Recording Law Compliance

Users are solely responsible for complying with all applicable laws when using ClarityPath, including laws governing the recording of conversations and the terms of any existing court orders. RECORDING CONSENT LAWS Recording consent laws vary by jurisdiction. Washington State operates under a one-party consent standard, meaning a party to a conversation may record it without notifying other parties. Many other states and jurisdictions require all-party consent. It is your responsibility to ensure any audio recordings or communications you upload were lawfully obtained under the laws of your jurisdiction. Clarity Path LLC is not responsible for determining whether your uploaded recordings comply with applicable law. COURT ORDER COMPLIANCE ClarityPath is a documentation and organizational tool. Nothing in the Service encourages or facilitates violation of any court order. Users agree to use ClarityPath only in ways that comply with all existing court orders applicable to their custody matter.

17. Professional User Acknowledgment

Attorneys, guardian ad litems, parent coordinators, and other legal or mental health professionals who access ClarityPath — whether through the attorney portal or otherwise — acknowledge the following: ClarityPath is a workflow and documentation tool, not a professional services platform. No output of ClarityPath — including pattern labels, AI summaries, declarations, or analyses — constitutes legal advice, forensic evaluation, clinical opinion, or professional work product attributable to any professional using the platform. Professionals using ClarityPath are solely responsible for independently evaluating all information accessed through the Service before relying on it in any professional capacity. Clarity Path LLC does not extend any malpractice liability coverage, professional indemnity, or warranty of fitness for professional use. Use of ClarityPath does not create any duty of care from Clarity Path LLC to any third party, including the professional's clients.

18. Indemnification

You agree to indemnify, defend, and hold harmless Clarity Path LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable attorneys' fees — arising out of or related to: • your use of ClarityPath • your violation of these Terms • content you upload, submit, or transmit through ClarityPath • your violation of any applicable law or the rights of any third party • any claim by a third party related to communications or recordings you upload to ClarityPath

19. Service Availability

Clarity Path LLC does not guarantee uninterrupted access to ClarityPath. The Service may be modified, suspended, or discontinued at any time without notice. Clarity Path LLC shall not be liable for any service interruptions.

20. Limitation of Liability

To the maximum extent permitted by law, Clarity Path LLC and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of ClarityPath. This includes but is not limited to: legal outcomes, custody decisions, court rulings, financial losses, or emotional distress. Use of ClarityPath is at the user's own risk.

21. Maximum Liability Cap

If Clarity Path LLC is found liable for any claim related to ClarityPath, total liability shall not exceed the amount paid by the user to Clarity Path LLC for the Service during the previous 12 months.

22. Intellectual Property

All software, design, trademarks, and intellectual property associated with ClarityPath are owned by Clarity Path LLC. Users may not copy, reproduce, or distribute any part of the Service without permission.

23. AI Training — Explicit Prohibition

Clarity Path LLC will never use your personal data — including incident descriptions, uploaded files, children's information, conversation messages, or any other individually identifiable content — to train, fine-tune, or improve AI or machine learning models, whether operated by Clarity Path LLC or any third-party AI provider. Aggregated, fully anonymized usage statistics (such as total feature usage counts with no user identifiers) may be used to improve system performance. This aggregated data cannot be used to identify you or reconstruct your content.

24. Data Retention and Deletion

Clarity Path LLC retains your data for as long as your account remains active. When you close your account or submit a deletion request, Clarity Path LLC will complete deletion of your personal data within 30 days. Child records you delete from your Profile are removed immediately and permanently. For complete details on data retention, see our Privacy Policy at clarity-path.ai/privacy. 25. Account Suspension or Termination

Clarity Path LLC reserves the right to suspend or terminate accounts that violate these Terms or misuse ClarityPath. Users may terminate their account at any time by contacting sarah@clarity-path.ai.

26. Changes to Terms

Clarity Path LLC may update these Terms from time to time. Continued use of ClarityPath after updates constitutes acceptance of the revised Terms.

27. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

28. Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. INFORMAL RESOLUTION FIRST Before filing any arbitration claim, you agree to contact Clarity Path LLC at sarah@clarity-path.ai and describe your dispute in writing. The parties agree to attempt to resolve the dispute informally for at least 30 days following Clarity Path LLC's receipt of your written notice. BINDING ARBITRATION If the dispute is not resolved informally within 30 days, any dispute arising from these Terms or your use of ClarityPath shall be resolved through binding arbitration administered by JAMS under its applicable rules. The arbitration shall take place in King County, Washington. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. CLASS ACTION WAIVER You agree not to participate in class-action lawsuits, class-wide arbitration, or representative actions against Clarity Path LLC. All disputes must be brought on an individual basis only. EXCEPTIONS Either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in court for claims involving intellectual property infringement.
