1. Introduction
Clarity Path LLC ("we," "us," or "our") operates the ClarityPath platform (the "Service"). We understand that the information you share with ClarityPath is deeply personal — it involves custody disputes, your children, uploaded communications, and legal strategy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and what rights you have over your data. By using the Service, you agree to the practices described in this Policy. If you do not agree, please do not use the Service.
2. Information We Collect
We collect the following categories of information: ACCOUNT INFORMATION • Name and email address (provided at registration via Clerk) • Authentication credentials managed by Clerk (passwords are never stored by Clarity Path LLC) PROFILE AND CASE INFORMATION • Your full name, case number, court name, and attorney information (if provided) • Children's first names and optional dates of birth (provided by you) INCIDENT AND CASE DATA • Incident descriptions, dates, categories, and notes you log • AI-generated summaries and pattern analyses associated with your incidents • Declarations and draft documents you generate UPLOADED COMMUNICATIONS AND FILES • Text screenshots, audio recordings, documents, images, and other files you upload as evidence • Court orders and case filings you upload AI CONVERSATION DATA • Messages you send to the ClarityPath AI companion • AI responses and coaching suggestions generated during your sessions USAGE DATA • Browser type, device type, IP address, and pages visited (collected via standard server logs) • Feature usage patterns used to improve the Service
3. How We Use Your Information
We use your information solely to provide and improve the ClarityPath Service: • To create and manage your account • To power AI analysis, pattern detection, and document generation specific to your case • To personalize coaching and communication suggestions using your profile and incident data • To generate court-ready drafts and reports based on your logged incidents • To provide the attorney portal (if you choose to grant attorney access) • To send transactional emails related to your account (via Resend) • To improve Service reliability and performance using aggregated, anonymized usage data We do not use your personal data for advertising, marketing to third parties, or any purpose unrelated to delivering the Service to you.
4. AI and Your Data
ClarityPath uses AI to analyze your incidents, suggest communication strategies, and generate draft documents. HOW AI USES YOUR DATA To provide guidance, the AI reads your case information — including incident descriptions, uploaded files, children's information, and conversation messages. This is how the AI features work: your data is the context the AI uses to give you relevant, personalized assistance. We do not hide or minimize this. WHAT THE AI NEVER DOES WITH YOUR DATA Your data is never used to train or improve any AI model — not by us, and not by our AI provider. ClarityPath uses the OpenAI API, and OpenAI is contractually prohibited from using API-submitted data to train or improve their models. Your data is transmitted to OpenAI solely to generate the response you requested; it is not retained by OpenAI for model training or any purpose beyond serving your request. AI-generated outputs may contain inaccuracies. You are solely responsible for reviewing all outputs before relying on them or sharing them with third parties, including attorneys or courts.
5. Third-Party Service Providers
We share your data with a limited set of service providers who help us deliver the Service. Each provider processes your data only as instructed by Clarity Path LLC and is prohibited from using it for their own purposes. INFRASTRUCTURE AND HOSTING Clarity Path LLC uses Replit infrastructure for application hosting and data storage. Your data is stored on Replit's platform. AI PROCESSING AI responses are generated via a proxy arrangement. Your data is transmitted to AI providers solely to process your request and return a response. We do not permit AI providers to use your data for model training. AUTHENTICATION Clerk manages user authentication. Clerk stores your email address and authentication credentials. See Clerk's Privacy Policy at clerk.com/privacy. EMAIL DELIVERY Resend processes transactional email delivery (account notifications). Resend does not have access to your case data. We do not sell, rent, or trade your personal data to any third party.
6. Attorney Portal Access
ClarityPath offers an optional attorney portal that allows you to share your case documentation with your attorney or guardian ad litem. WHAT IS SHARED If you invite an attorney, they receive read-only access to your confirmed incidents, timeline, uploaded court orders, and generated declarations. They cannot modify, delete, or add data. YOUR CONTROL You control attorney access. You may revoke access at any time from your profile settings. Revoking access immediately terminates the attorney's ability to view your data. ATTORNEY DATA HANDLING Attorneys access your data only through the ClarityPath portal. They are governed by ClarityPath's Terms of Use when using the portal. Clarity Path LLC is not responsible for how attorneys use information they view or download through the portal.
7. Children's Data (COPPA)
ClarityPath is designed for parents and legal guardians aged 18 and older. Children do not create accounts or directly interact with the Service. WHAT CHILD INFORMATION IS COLLECTED When you voluntarily provide it, we collect your child's first name and optional date of birth. This information is provided by you — the parent or guardian — and is used only to personalize your ClarityPath experience. HOW CHILD DATA IS USED Child information is used only to: • Personalize AI coaching and communication suggestions • Generate accurate court-ready declarations and incident records • Organize incidents by child, where relevant We do not share child information with third parties for advertising or marketing, use child names or birthdates to build profiles of children, or sell, rent, or disclose child information to any third party. PARENTAL RIGHTS OVER CHILD DATA You may review, update, or delete child records from your Profile at any time. Deleting a child record removes it immediately and permanently. When you close your account, all associated child data is deleted. To exercise these rights or request assistance, contact us at sarah@clarity-path.ai.
8. Uploaded Third-Party Communications
You may upload communications involving third parties — including the other parent, family members, or others — as evidence. By uploading such communications, you represent that you have the legal right to store and use them on the Service, and that doing so does not violate applicable laws, including recording consent laws in your jurisdiction. Washington State operates under a one-party consent standard for recorded conversations. Laws vary by jurisdiction. It is your responsibility to ensure any uploaded recordings were lawfully obtained. Clarity Path LLC does not review or verify uploaded communications for legal compliance.
9. Data Retention and Deletion
ACCOUNT DATA Your data is retained for as long as your account remains active. When you close your account, we initiate deletion of your personal data within 30 days. CHILD RECORDS Deleting a child record from your Profile removes it immediately and permanently. UPLOADED FILES Files you delete from your account are removed from active storage within 30 days. RESIDUAL DATA Some data may remain in encrypted backups for up to 90 days following deletion, after which it is permanently purged. REQUESTING DELETION You can delete your account and all associated data directly from your Profile settings ("Data & Privacy" → "Delete my account"). Deletion begins after a short grace period during which you may cancel, and is completed within 30 days. You may also request deletion by contacting us at sarah@clarity-path.ai; we will confirm receipt and complete deletion within 30 days. EXPORTING YOUR DATA You can download a complete archive of your data (documents, incidents, evidence, and drafts) at any time from your Profile settings ("Data & Privacy" → "Export my data").
10. Your Privacy Rights
WASHINGTON STATE RESIDENTS Under Washington law, you have the right to access, correct, delete, and obtain a copy of your personal data. You also have the right to opt out of any sale or sharing of personal data (we do not sell your data). To exercise these rights, contact sarah@clarity-path.ai. CALIFORNIA RESIDENTS (CCPA) If you are a California resident, you have the right to: • Know what personal information is collected and how it is used • Delete your personal information • Opt out of the sale of your personal information (we do not sell your data) • Non-discrimination for exercising your privacy rights To submit a California privacy request, contact sarah@clarity-path.ai. HOW TO EXERCISE YOUR RIGHTS Email sarah@clarity-path.ai with the subject line "Privacy Rights Request" and describe your request. We will respond within 45 days.
11. Security
Clarity Path LLC implements reasonable technical and organizational safeguards to protect your data, including: ENCRYPTION IN TRANSIT AND AT REST All data exchanged between your device and ClarityPath is protected by TLS (Transport Layer Security). Your stored case records, incident descriptions, uploaded files, and documents are encrypted at rest on our hosting infrastructure. ROLE-BASED ACCESS CONTROL Client accounts and attorney access are strictly separated. Attorneys and other third parties can only access your case data when you explicitly invite them — access is never granted by default. You can revoke attorney access at any time from your profile settings, which takes effect immediately. AUTHENTICATION User authentication is managed by Clerk using industry-standard security practices. Clarity Path LLC does not store or have access to your password. No system can guarantee absolute security. By using the Service, you acknowledge that data transmission and storage involve inherent risks. 12. Washington My Health MY Data Act
To the extent that any health-related information you voluntarily share with ClarityPath (for example, references to mental health, medical conditions, or medical appointments in your incident descriptions) constitutes "consumer health data" under the Washington My Health MY Data Act (MHMD), Clarity Path LLC handles such information consistent with the Act's requirements. We do not collect consumer health data for any purpose other than delivering the Service to you. We do not sell consumer health data. You may request deletion of consumer health data by contacting sarah@clarity-path.ai.
13. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or the Service. When we make material changes, we will notify you by email or by a prominent notice within the Service. Continued use of the Service after the effective date of any updated Policy constitutes your acceptance of the revised terms.
